Introduction

Thank you for your interest in joining Tau Motors, Inc. and/or any Tau affiliate companies (collectively “Tau,” “we,” “our,” or “us”). Protecting your privacy is important to us. This Job Applicant Privacy Notice (“Notice”) explains how we collect, use, and share personal information when you apply for a job with Tau.

Scope and applicability

This Notice applies to job applicants and describes Tau’s privacy practices when you apply for employment or are considered for a position with Tau. Capitalized terms not defined in this Notice are defined in our Data Protection Policy.

This Notice does not cover the following:

  • Tau partners and users. For more information about our Services for our partners and users, please see our Privacy Policy.

  • Tau Employees (unless applying for a new position within Tau). Please contact privacy@taumotors.com to learn more about our privacy practices regarding the personal information of Tau employees.

Tau does not recruit or hire the following for full time positions:

  •  Children under 18. We will not process or retain job applications from children under 18, nor do we direct information toward audiences under 18.

  • Children under 14. We will not process or retain internship applications from children under 14, nor do we direct information toward audiences under 14.

Information we collect

We collect and process personal information for recruitment, interviewing, and hiring purposes as described in this Notice (collectively, “Recruitment Activities”). To learn about your information collection choices, see the “Your Privacy Choices and Rights” section below.

Information You Provide to Us
In addition to the information we collect when you use our Services, described in our Privacy Notice, we collect the following information directly from you as part of our Recruitment Activities:

  • Academic and professional experience such as employment history, level of education, skills, certifications, professional affiliations, and other relevant career information you choose to provide; and

  • Work eligibility such as your eligibility to work in the country where you applied for a job and your start date.

Publicly Available Information
We also may receive information from publicly available sources and social media websites, such as LinkedIn, during our Recruitment Activities.

Information We Collect from Third Parties
We receive information about you from third parties, such as recruiting agencies, background check suppliers, educational institutions and former employers, to engage in and support our Recruitment Activities. We limit the processing of your personal information to the purposes described in this Notice.

Personal information that third parties share with us includes:

  • Contact information; and

  • Academic and professional background information, such as referrals from current and former employees, contractors, recruiting agencies, or background check suppliers.

Third parties that collect personal information may have their own privacy notices which govern how your personal information is shared or used. We encourage you to read those notices carefully, and to contact the third party directly if you have any questions about their privacy practices.

How we use information

When you interact with us during our Recruitment Activities, we use your personal information in the following ways:

  • Communicate with you. We use your personal information to engage with you, including contacting you during the screening and interviewing process and communicating with you through our Recruitment Activities.

  • Provide our Recruitment Activities. We use your personal information to provide, operate, monitor, and maintain our Recruitment Activities, such as to evaluate and verify your application and qualifications for employment, prepare for and conduct interviews and screenings, conduct background and criminal checks, check references, confirm academic achievement, arrange travel where applicable, or reimburse you for travel expenses.

  • Provide and improve functionality. We use your personal information to provide you with the functionality required during Recruitment Activities to analyze how you interact with our Recruitment Activities, and improve functionality, quality, and user experience. For example, we collect information about which websites you visited before applying to determine the effectiveness of our job postings. We also collect your information to determine whether you have previously visited our career page or previously applied for a job at Tau.

  • Promote the security of our Recruitment Activities. We use your personal information to investigate and prevent fraudulent behavior, unauthorized access related to Recruitment Activities and other illegal activities by verifying that the information you and others provide is true and accurate, such as for reference checks.

  • Develop and improve our Recruitment Activities. We process your personal information for legitimate business purposes, such as internally evaluating our recruitment process, submitting reports as required by law, and conducting analytics.

  • Legal, Regulatory, Safety and Compliance purposes. We use your personal information for compliance with laws or regulations, resolving legal disputes, and reviewing compliance with applicable usage terms, such as work eligibility in the country of employment.

  • Meeting any Statutory and/or Regulatory Reporting Obligations. We collect your personal information to evaluate whether we are meeting our internal recruiting commitments to diversity and for collecting and/or submitting applicant data as required to regulatory authorities such as the Equal Employment Opportunity Commission.

  • Other purposes. If we use your personal information for other purposes not described above, we will notify you in advance and ask for your consent.

We only use personal information we have about you where it is permitted by law or required to do so as an employer, including where we have a legal obligation, for our legitimate business purposes, to protect your vital interests, or if we have your consent.

How we share information

We share your personal information with third parties as required by law and as part of our business practices, as described below.

We work with service providers such as skills evaluation providers, recruiting and HR software providers, recruiting agencies, and consultants to help us with our Recruitment Activities. Under contract with Tau, these third parties are authorized to use your personal information only as necessary to provide these services or perform them on our behalf.

Confidentiality

We respect the importance of keeping your information confidential and communicating the expectations of privacy while working with us. We ensure that the appropriate safeguards are in place to protect the security, integrity, and confidentiality of your personal information.

The confidentiality obligation applies to all personal information that is legitimately processed. Tau prohibits the use of your personal information for private or commercial purposes, to disclose it to unauthorized persons, or make it available in any other way.

Retention of information

Except as otherwise permitted or required by applicable law or regulatory requirements, we may retain your personal data only for as long as we believe it is necessary to fulfill the purposes for which the personal data was collected (including, for the purpose of meeting any legal, accounting or other reporting requirements or obligations) and for IT archival purposes.

Personal data for data subjects in the European Union is erased after termination of your employment, with the exception of certain types of personal data, which may be stored for an extended period of time due to administrative purposes, e.g. for payment of retirement income or for giving references to other employers, or where such personal data must be retained to comply with regulatory requirements.

You may request that we delete the personal data about you that we hold, provided that we reserve the right not to grant such request if we are not required to delete personal data under applicable law. There are instances where applicable law or regulatory requirements allow or require us to refuse to delete this personal data. In the event that we cannot delete your personal data, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

International transfers

If you provide us with your personal information, we may transfer your personal information to other countries. Some of these countries may have different data protection laws than the country in which you initially provided the information to us, and you may have fewer rights with respect to your personal information. If you do not want your personal information transferred to other countries, please do not submit any information to us.

To the extent required by law, we will take measures to protect the cross-border transfer of your information.

Legal basis for processing (for EEA Job Applicants)

If you are an individual from the European Economic Area (“EEA”), we collect and process your personal data only where we have legal basis for doing so under applicable European Union laws. The legal basis depends on Tau’s relationship to you and how you choose to interact with us. This means we collect and use your personal data only:

  •  To fulfill our contractual obligations to you;

  • To operate our business, including to improve and develop our Recruitment Activities, for fraud prevention purposes, improve user experience, or other legitimate interest; and/or

  • As otherwise in compliance with law.

Your privacy choices and rights

You have certain choices and rights available when it comes to the personal information that we collect.

Your choices
Where appropriate or legally required, we describe how we use the personal information collected, so you can make choices about your personal information. To update your preferences, correct your information, limit the communications you receive from us or submit a request to exercise your rights, please  contact us as specified in the “Contact Us” section.

Your privacy rights

  • You have certain rights in connection with your personal information. Based on your jurisdiction, you may have certain privacy rights, such as:

  • Request access to certain personal information we maintain about you;

  • Request that we update, correct, amend, erase, or restrict processing of certain personal information;

  • Object to some forms of automated decision-making or profiling;

  • File a complaint with a relevant European Data Protection Authority; and

  • Exercise your right to data portability.

Deleting your information will remove you from consideration for employment with Tau. You may also request that we withdraw your application for a specific position without deleting your information.

To help protect your privacy and maintain security, we take steps to verify your identity before responding to requests. To verify your identity to make the request and confirm the personal information related to you, we may ask for information that appeared on your job applicant such as name and submission record.

We will respond to requests within a reasonable amount of time, depending on your jurisdiction. Your request and choices may be limited in certain cases, for example, if fulfilling your request is not permitted by law or if we have compelling legitimate interests to keep your information. If you have unresolved concerns, you may have the right to complain to a data protection authority in the country where you live, where you work or where you feel your rights were infringed.

Opt out of communication

When you engage in our Recruiting Activities, you may receive emails or other forms of communication from us. You can opt-out of recruiting and event communications by following the unsubscribe instructions included in these emails.

Complaints

To the extent that the above rights apply to you, we encourage you to contact us with any complaints and issues at privacy@taumotors.com. If your complaints or issues remain unresolved, you may also address any grievance directly with your jurisdiction’s relevant supervisory authority.

Changes to this notice

We periodically review and update this Notice to describe changes to our practices. You can determine when this Notice was last revised by referring to the “Updated” date at the top of this Notice. We encourage you to review the Notice whenever you interact with our Recruitment Activities to stay informed about our privacy practices and the ways that you can help protect your privacy.

If we make significant changes to this Notice, we will notify you through the email address associated with your application. If you do not agree with the privacy practices disclosed in the Notice, we recommend you stop engaging in our Recruitment Activities.
